Terms and conditions of website use

In accessing and using the Old Scotch Collegians’ Association (‘OSCA’) ‘OSCAnet’ and ‘OSCAconnect’ websites (collectively the ‘OSCA Websites’), you agree that any such visits and use will be in accordance with these terms and conditions and any applicable OSCA policies, including but not limited to, the OSCA Privacy Policy, as published on the OSCA Websites.

When you visit and use aspects of an OSCA Website, our systems may record certain information about your navigation and use of those web sites (such as which web pages you visit and the time and date of your visit and use). We use this information to help analyse and improve the performance of the OSCA Websites.

When you send us any feedback, suggestions, ideas or other materials in relation to or via the OSCA website, you agree that OSCA can use, reproduce, publish, modify, adapt and transmit them to others free of charge and without restriction, subject to our obligations in the OSCA Privacy Policy.

In addition, we may use “cookies” on the OSCA Websites. Cookies are small text files that help a web site to remember your preferences and improve your experience of using that aspect of the web site. In some cases, the cookies that we use may collect some personal information about you. We will treat this information in the same way as other personal information we collect about you, in accordance with the OSCA Privacy Policy and the relevant Australian privacy laws. We note that some internet browsers allow for users to be able to disable cookies while using websites.  If you do so, the OSCA Websites may not necessarily provide you with the most efficient user experience.

From time to time OSCA may engage third parties to help analyse how the OSCA Websites are used and determine the optimal design and functionality for the sites to enhance OSCA’s and users’ experience on the OSCA Websites. While any such analysis would be performed using data collected from the OSCA Websites, it is OSCA’s intent that this information will not include any personal information.

OSCA may also collect Internet Protocol (IP) addresses relating to you when you access and use the OSCA Websites. IP addresses are assigned to computers on the internet to uniquely identify them within the global network of computers which makes up the internet. OSCA may collect and manage IP addresses for internet session management and security purposes.

Passwords and usernames

In some circumstances, OSCA may issue you with usernames or passwords to allow you to access some of the content and information on certain OSCA Websites.

While OSCA will use all reasonable efforts to ensure that usernames and passwords are not disclosed to other people, you are ultimately responsible for maintaining the security and secrecy of your usernames and passwords.

OSCAconnect and other directories

You acknowledge and agree that the use of OSCAconnect and any resources provided by that service, such as a register of members of OSCA and/or business directory (collectively, the ‘Directories’) will be subject to the following:

• OSCA’s role in providing the Directories is solely to act as a facilitator to enable OSCA members to pass on their knowledge, expertise and/or services to other members.
• Whilst all reasonable efforts have been taken to ensure the accuracy of the information provided in the Directories (including to correct errors or omissions within a reasonable period of time after notification), OSCA does not guarantee that the Directories will be accurate, complete, reliable, current or error-free.
• Information included in the Directories may be changed, modified or removed at any time without notice.
• Information in the Directories is provided for the use of OSCA members only. Unless prior authorisation has been obtained from OSCA, an OSCA member is not permitted to provide access to these Directories to any third party who is not already an OSCA member, and such information is not to be copied and shared to any such third party.
• OSCA does not guarantee uninterrupted access to the Directories, and access to the Directories may be suspended, restricted or terminated at any time, at the absolute discretion of OSCA.
• While OSCA will treat any information directly provided to it in accordance with the OSCA Privacy Policy, if you broadcast personal information on any of the Directories, it will be visible to other OSCA members registered to use the site.

Reliance on information

While OSCA will use reasonable endeavours to provide accurate information on the website, it does not warrant that the information is accurate, current or complete, especially as certain information published on the site is provided by Scotch College, OSCA members in a personal capacity, or OSCA affiliated clubs and associations, and not OSCA itself.

OSCA makes no warranties that the information published or materials hosted on the OSCA Websites are free of infection by computer viruses or other contamination.

Copyright

All copyright in the OSCA Websites (including in in OSCAconnect and the Directories) is owned or licensed by OSCA, except for your personal information and any other information or content provided by you. If you choose to broadcast material on OSCAconnect, in doing so you warrant that broadcasting such material on OSCAconnect does not breach any third-party intellectual property rights, and you provide a non-revocable, royalty-free licence for OSCA to continue to the broadcast of that material on any of the OSCA Websites.

Third party websites

The OSCA Websites may contain links to third party websites. OSCA is not responsible for the condition or the content of those third-party websites, as they are not under OSCA’s control.

Any links provided are solely for your convenience. The presence of links does not amount, expressly or impliedly, to any endorsement of the websites or the products or services provided there.

Your access to those websites and use of their products and services is solely at your own risk.

Terms and Conditions of attending OSCA Events

OSCA may, from time to time, facilitate the online booking of tickets to OSCA-related events through third party sites (such as ‘Trybooking’). In doing so, a selection to make a booking may link you to a third-party website. If you provide personal information or make a purchase via such a third-party website, you do so in accordance with the terms and conditions of that third-party provider.

Further, the following terms and conditions apply to OSCA members, guests, and other participants and attendees at OSCA events (such as dinners, training, workshops, professional development, and conferences).

• Tickets:
  You acknowledge that for some events there is limited ticketing and that OSCA reserves the right to determine for each event how many guest tickets will be allocated for each member.
  If the event is ticketed, only official events tickets (physical or digital) will be accepted for entry into such events.
• Behaviour:
  While present at a OSCA members’ event, you or your guests agree to act safely and in accordance with all lawful and reasonable requirements and directions of OSCA, its authorised representatives or the relevant venue operator or authorities.
  OSCA and its accredited, appointed caterers follow guidelines for the responsible service of alcohol, which include instructions not to serve any alcoholic beverages to attendees under the age of 18 years, or who are reasonably believed to be in an unlawful state of intoxication. If OSCA (or its authorised representatives, venue operator or relevant authorities) reasonably believes you to be in a state of intoxication at an OSCA event, you and your guests may be asked to leave, and if so, must do so immediately.
• Marketing & Promotions:
  Attendees at OSCA events acknowledge and agree that attending an event may involve being photographed. You agree that by attending a OSCA event, OSCA may use all photographs and videos taken by it at the event without restriction and without further recourse to you or your guests in its advertising and promotional materials and official communications, forever and in any media whatsoever.
  Except for the private enjoyment of the person taking or making the images, you or your guests, as attendees, must not take or make any audio or video recordings, films, still pictures, photographs or any other images within a OSCA event. Any such audio or images from OSCA events may not be used by you or your guests for profit, gain, public advertisement or for any other commercial purpose, including but not limited to, provision to media outlets.
• Payment:
  All event bookings must be accompanied by full payment in the form of a cheque, completion of the credit card details on the relevant booking form or website payment platform, or as provided to OSCA over the phone at the time of booking. OSCA will only confirm bookings once full and cleared payment from the member is received. Where payment has not been made by the time of the event the full booking cost will remain due.
• Non-Attendance:
  If you are unable to attend you may send a substitute at no extra cost, provided that you notify us of the change at least 24 hours prior to the event. If you fail to notify us of the change OSCA will charge for an additional place. In the event of non-attendance and non-substitution you will be liable for the full cost of the ticket for the event.
• Cancellation:
  If cancellation is made up to 7 business days prior to the event a full refund of the booking cost will be issued. If cancellation is made less than 7 business days prior to the event 100% of the event ticket cost will apply. If the event is cancelled due to circumstances beyond OSCA’s control, OSCA will not be liable for any additional costs incurred by attendees (e.g. travel or accommodation).

 Where an OSCA event is held at a third-party venue, additional entry terms and conditions may apply, as determined by the ticket provider or venue.

Liability

To the maximum extent permissible by law, OSCA:

• excludes all terms, conditions, warranties and representations (whether express or implied) relating to the OSCA website and the material contained on this website, OSCAconnect or the Directories; and
• expressly disclaims any liability for a breach of these terms and conditions.

OSCA excludes all liability and responsibility imposed on it (and any of its directors, committee members, officers, employees, appointed representatives, related companies, affiliates or agents) for any loss or damage that may be incurred by you or any other person, including without limitation any direct, indirect, punitive, consequential or special loss or damage, and whether in tort (including, but not limited to, negligence), contract or otherwise, in connection with use of the OSCA website and the material contained on this website, OSCAconnect or the Directories, or any website linked to this website.

In using the OSCA website, you acknowledge that any damage caused to you or any third party as a result of a breach by OSCA of these terms and conditions, if not legally permitted to be excluded, shall be limited to the amount recoverable under applicable legislation and otherwise not be recoverable from OSCA or any of its related bodies.

Miscellaneous

OSCA reserves the right to vary these terms and conditions from time to time, such as to take account of changes to its policies or to relevant laws. Such variations will take effect immediately upon the posting of the varied terms and conditions on the OSCA website. In continuing to use this website and associated services you will be deemed to accept such variations.

If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and where capable the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

These terms and conditions will be governed by and construed in accordance with the laws of Victoria, and any disputes relating to these Terms will be subject to the exclusive jurisdiction of Victorian courts.
